The Terms and Conditions rule your Use of the Website. Please read the Terms and Conditions carefully and ensure that you have fully understood them. If you do not agree to the Terms and Conditions, please stop Use of the Website immediately. The Website is owned and managed by Global Dinners Limited, who can be contacted at info@globaldinners.com.



1. Definitions
1.1 "Global Dinners" (or "we", "us" or "our") means Global Dinners Limited a company registered under company number 10991015.
1.2 “Customer” or “user” means any individual, registered or not, within the platform who interacts with the website and/or purchases a service i.e a “dinner”.

1.3 “Dinner” means meals held at Restaurants with a particular time and place that are advertised for sale on the Website at any given time.
1.4 "Functions" means the functions, facilities and/or services we may make available to Users on or through the Website from time to time
1.5 "Use" (and "Uses" and "Using") means any access to the Website, including using the Functions and purchasing Meals or services.
1.6 "User" means an individual that Uses the Website and includes Customers (and "you" and "your" means you or the relevant User of the Website)
1.7 “Website” means the website hosted at www.globaldinners.com and all related websites and web and mobile applications.
1.8 “Dining Receipt” means a commercial invoice for the purchase of a Meal issued by Global Dinners.
1.9 “Restaurant” means a restaurant that hosts Dinners.
1.10 "Terms" means these terms of use.

2. General
2.1 By using the Website you agree on this Terms and Conditions, including our Privacy Policy. This is effective immediately within accessing the Website and is valid for any following occasion.

2.2 If you do not agree to be legally bound by the Terms and Conditions please do not access or Use the Website.
2.3 Terms and Conditions are subject to change at any time. Such changes will be posted changes on the Website. Please review the Terms and Conditions on regular basis by referring to the date displayed at the top. After changes are posted, all Uses of the Website are understood to be done under agreement of the last updated version.


3. Use of the Website
3.1 To Use the Website (whether with or without registration) you must be 18 years of age or over.
3.2 The Website is intended to be used solely for viewing Dinners, purchasing Dinners and/or contacting Global Dinners. Global Dinners reserves the right in its sole discretion to take action against any misuse of the Website.

3.3 Users are allowed to create only one account under your own name.
3.4 Users are responsible for obtaining and maintaining all telephone, computer hardware and other equipment needed for access to and use of the Website and all charges related thereto. Global Dinners shall not be liable for any damages to the User’s equipment resulting from the use of the Website.
3.5 The User of the Website shall not (nor permit anyone else on his/her behalf to):
(a) engage in any conduct which, under our sensible judgement, is detrimental or restricts or inhibits any other User from Using the Website.
(b) misuse the Website by knowingly introducing viruses, trojans, worms, logic bombs or any technologically harmful material;
(c) use the Website to collect email addresses, personal details or Meal details for commercial purposes or any other purpose whatsoever.

(d) include any links to the Website except links that are fair and legal and do not suggest any form of association, approval and/or endorsement by Global Dinners of the website on which the link is included. Global Dinners can withdraw the linking permission contained in this clause 3.5 (d) at any time for any reason;
(e) attempt to gain unauthorised access to the Website, the server on which the Website is stored or any server connected to the Website and must not attack the Website via a denial of service attack or distributed denial of service attack (breach of this clause 3.5(e) constitutes a criminal offence under the Computer Misuse Act 1990 and Global Dinners may report any such breach to the relevant law enforcement authority and co-operate with such authority by disclosing your identity to such authority);
(f) provide false data including false names, addresses and other contact details;
(g) use credit/debit card numbers or PayPal accounts fraudulently;
(h) attempt to circumvent our security or network including accessing data not intended for you, logging into a server or account you are not expressly authorised to access, or probing the security of other networks;
(i) access the Website in such a way as to, or commit any act that would or does, impose an unreasonable or disproportionately large load on our infrastructure;
(j) execute any form of network monitoring which will intercept data not intended for you; or
(k) engage in any unlawful activity in connection with the use of the Website or any Dining Receipt or Meal.

4. Site Content
4.1 You agree not to copy, imitate or replicate, in whole or in part, the Functions.
4.2 The information contained on the Website, including without limitation, artwork, text, video, audio, pictures, software and other intellectual property ("Materials") are protected by copyright and may not be copied, reproduced, republished, downloaded, posted, modified, broadcast, publicly displayed or transmitted in any way except for your own personal non-commercial use. Any other use requires the prior written permission of Global Dinners. You agree not to adapt, alter or create a derivative work from any of the Materials. You further acknowledge and agree not to use the Materials for any other purpose other than for your personal non-commercial use.
4.3 The names, images and logos used on the Website may be protected by copyright, design rights and trademarks. Nothing contained in the Terms and Conditions shall be construed as conferring by implication, estoppel or otherwise any licence or right to use any trademark, patent, design right, copyright or any other intellectual property used on the Website. The provisions of this clause 4 shall apply equally to and are for the benefit of Global Dinners, its subsidiaries, affiliates, Restaurants and its third party content providers and licensors and each shall have the right to assert and enforce such provisions directly or on its own behalf.

5. Registration, Accounts, Functions
5.1 We may make available on or through the Website various Functions from time to time. We reserve the right to update, amend, change or withdraw the Functions and/or to introduce new Functions at any time without prior notice. Such changes may include, among other things, the adding of certain fees or charges.
5.2 We reserve the right to refuse the registration of a new account or cancel any existing one on the Website for any reason.
5.3 To create an account you need to supply information that may include but not necessarily limited to your name, location, email address, phone number and possibly some other personal information. Please refer to our Privacy Policy for more details about this.
5.4 In order to create your account, you will be asked to supply a password. It is your own responsibility to keep the password confidential and immediately notify us if any third party becomes aware of that password or if there is any unauthorised use of your email address or any other breach of security that you become aware or suspect of. You agree that any person to whom your account username or password is disclosed is authorised to act as your agent for the purposes of Using the Website.

5.5 All accounts must be registered with a valid personal email address that you access regularly. Any account that has been registered with someone else’s email address or with temporary email address may be cancelled without prior notice. We may require users to re-validate their accounts if we suspect they have been registered with an invalid email address.
5.6 You warrant that all information provided in or to create your account is true, complete and accurate and that you will promptly inform us of any changes to such information by updating the details in your account.

6. Purchase of a Dinner
6.1 Global Dinners organizes Dinners via the Website that can only be redeemed by the User

6.2 As a condition of purchasing a Dinner, we reserve the right to send you emails. We may send you information regarding your account activity and purchases, updates about the Website, Dinners, and occasional promotional offers.
6.3 By purchasing a Dinner, you acknowledge that the purchase is made subject to the Terms and Conditions.
6.4 All Restaurants may have their own applicable terms and conditions, in relation to dining in their establishment and you agree to (and shall) abide by those terms and conditions. The responsibility to do so is yours alone. There may also be additional terms and conditions relating to the Dinner set out on the Website and/or the Dining Receipts.
6.5 The Restaurant, and not Global Dinners, is: (a) the seller of the Meal; (b) solely responsible for providing you with the Meal.


7. Cancellations
7.1 You can cancel your place at a dinner at any time by sending an email to help@globaldinners.com.
7.2 We will not be able to refund your prepayment if you cancel less than 48 hours before the dinner.


8. Dinners

8.1 Your purchased Dinner entitles you to the meal only. Any extras such as drinks, desserts or any other items need to be paid by the user directly to the Restaurant unless the Dinner details show the opposite. Details on what is included will be displayed in the Dinind Receipt.
8.2 In the case your photograph is taken by our photographer at a Dinner, you give us permission to display, post or publish such photograph on the Website or any other website at our discretion and to use the same for advertising and promotion.
8.3 By attending a Dinner you agree to: (a) behave responsibly and in a proper manner and not to do anything unlawful or that may negatively affect or which violates or infringes the rights of a third party at a Dinner or elsewhere; (b) defend, indemnify and hold Global Dinners harmless from any claim, suit or demand, including reasonable legal fees, made by a Restaurant due to or arising out of your behaviour and/or actions at a Dinner, your breach of the Terms, your interference with any rights of a third party or any other act or omission by you at a Dinner or otherwise.
8.4 Restaurants shall have the final right to reasonably refuse admission to a Customer at a Dinner.

8.5 All disputes regarding bar and/or table bills and/or damage or loss caused by a Customer shall be between Customer and Restaurant.

9. Termination
9.1 You may at any time cease to be a User of the Website and terminate these Terms and Conditions by going to www.globaldinners.com and choosing the relevant option.
9.2 We may provide you with notice at any time by email to the email address provided by you that we wish to terminate the Terms and Conditions and prevent any further Use by you.
9.3 If we consider in our absolute discretion that you are in breach of any of the provisions of the Terms and Conditions, we reserve the right to prevent your continued Use of the Website without notice and to take (or refrain from taking) all other steps that we consider appropriate in relation to your Use of the Website, including without limitation removing and/or suspending your account. In such circumstances, you agree not to create a Global Dinners account under another name or identity.
9.4 Termination of the Terms and Conditions shall be without prejudice to the rights and remedies of Global Dinners in respect of any breach of these Terms and Conditions occurring prior to such termination.

10. Disclaimer, limitations of liability, indemnity
10.1 The Website and the Materials, information, names, images, pictures, logos and icons regarding or relating to Global Dinners, its products and services (or to third party products and services) are provided on an “as is” basis with no representation or warranty of any kind express or implied statutory or otherwise regarding the same or the availability of the Website or that it will be timely or error-free, that defects will be corrected, or that the Website or the server that makes it available are free of viruses or bugs or that it represents the full functionality, accuracy, reliability of the Website.
10.2 Global Dinners shall use reasonable commercial endeavours to maintain the Website but reserves the right from time to time to suspend the Website for upgrades or work to the Website or any other purpose that it deems reasonably necessary. There may be errors on the Website and from time to time it may not be available to the Users.
10.3 Under no circumstances will Global Dinners be liable for any of the following losses or damage (whether such losses were foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from your Use of the Website regardless of the form of action.
10.4 In no event will Global Dinners’s liability in connection with a Meal Dinner exceed the amounts paid for such Meal Dinner and total aggregate liability arising out of or related to the Terms and Conditions shall not exceed the amounts paid by a User during the six months preceding the bringing of any claim.
10.5 You agree to defend, indemnify and hold Global Dinners harmless from any claim, suit or demand, including reasonable legal fees, made by a third party due to or arising out of your Use of the Website, attendance at a Dinner, the Materials or related services, your breach of the Terms and Conditions, your interference with any rights of a third party, or any other act or omission by you.
10.6 If the Website provides links to other websites and you use those links, you will leave the Website. We do not control and are not responsible for any of these other websites (save for other Global Dinners websites) or their content. We do not endorse or make any representations about them, or any information or products or materials you may find there. If you decide to access any website linked to the Website, you do so entirely at your own risk.
10.7 Global Dinners accepts no liability of any kind for any loss or damage from action taken in reliance on material or information contained on the Website unless due to our negligence. All facts, views and information on the Website are for information purposes only and should not be construed as advice, nor relied on by Users to make decisions. Any facts, views, information, opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties, including Restaurants, are those of the respective Restaurants not of Global Dinners.
10.8 Global Dinners neither endorses nor is responsible for the accuracy or reliability of any opinion, advice, or statement made on the Website by anyone other than authorised Global Dinners spokespersons while acting in official capacities. Under no circumstances will Global Dinners be liable for any loss or damage caused by a User’s reliance on information obtained through Global Dinners. It is the responsibility of User to evaluate the accuracy, completeness, or usefulness of any information, opinion, advice, etc., or other content available through Global Dinners.
10.9 Nothing in the Terms and Conditions and in particular this clause 10, seeks to disclaim or limit liability for death or personal injury that is caused by our negligence or that is otherwise not permissible under any applicable law.

11. Warranties
You hereby warrant that: (a) you have the right, authority and capacity to enter into the Terms and Conditions and be bound by them; (b) you will comply with all local laws that relate to your Use of the Website; and (c) you are solely responsible for your Use of the Website.

12. International use
We make no representation that any of the Materials or any other materials on the Website are appropriate or available for use in locations outside the United Kingdom, and accessing them from territories where their contents are illegal is prohibited. Those who choose to access the Website from locations outside the United Kingdom do so at their own risk and are responsible for compliance with local laws.

13. Entire agreement
Save in respect of Users that have entered into separate written agreements with Global Dinners, these Terms and Conditions and the Privacy Policy set out the entire understanding and agreement of the parties as to the subject matter hereof and supersede all prior proposals, discussions or agreements with respect thereto.

14. Miscellaneous
14.1 If there is any conflict between the Terms and Conditions and specific terms appearing elsewhere on the Website or any other Global Dinners website then the Terms and Conditions shall prevail.
14.2 If any of the Terms and Conditions are determined to be illegal, invalid or otherwise unenforceable under UK law, then to the extent that term is illegal, invalid or unenforceable, it shall be severed and deleted from the Terms and Conditions and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.
14.3 The Terms shall be governed by and interpreted in accordance with the laws of England and Wales whose courts shall have exclusive jurisdiction in relation to any disputes arising under the Terms.
14.4 Global Dinners reserves the right to transfer, assign, novate or sub-contract the benefit of the whole or part of any of its rights or obligations under the Terms to any third party. You may not assign, novate or sub-contract any of your rights or obligations under the Terms to any third party unless agreed in writing by Global Dinners.
14.5 Global Dinners reserves the right, at any time, without prior notice, to assign, transfer or license, a User's Global Dinners’s account to another legal entity.
14.6 No provision of the Terms and Conditions shall be enforceable by a third party under the Contracts (Rights of Third Parties) Act 1999.
14.7 Delay in exercising, or a failure to exercise, any right or remedy in connection with the Terms and Conditions shall not operate as a waiver of that right or remedy. A single or partial exercise of any right or remedy shall not preclude any other or further exercise of that right or remedy, or the exercise of any other right or remedy. A waiver of a breach of the Terms and Conditions shall not constitute a waiver of any subsequent breach.
